Welcome to Orby. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our application.

These Terms constitute a legally binding agreement between you and Orby. Please read them carefully.

2. Description of Service

Orby is a vision training and eye wellness application that provides:

• Guided eye exercises across categories such as tracking, focus, binocular vision, and relaxation
• Self-administered vision tests (visual acuity, astigmatism, Amsler grid, contrast sensitivity, color vision)
• Daily goals, streaks, and progress tracking
• Optional reminders and 20-20-20 screen break notifications
• Premium content via the Orby Plus subscription

The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Medical Disclaimer

Orby is not a medical device. The exercises, vision tests, and content provided in the app are intended for general wellness, relaxation, and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.

• The vision tests in Orby are simplified screening tools and cannot replace a professional eye examination
• Orby does not treat, cure, or prevent any eye disease or medical condition
• Always consult a qualified eye care professional (optometrist or ophthalmologist) regarding any questions or concerns about your vision
• Stop any exercise immediately if you experience pain, dizziness, or discomfort
• Never delay seeking professional medical advice because of information or results provided by the app

4. User Conduct

When using Orby, you agree to:

• Use the app for lawful purposes only
• Not attempt to reverse engineer, decompile, or disassemble the app
• Not use the app to transmit malicious code or viruses
• Not interfere with or disrupt the service
• Not use automated systems to access the app
• Respect intellectual property rights
• Not share premium subscription access with others

5. Intellectual Property Rights

App Content:
Orby and all its original content, features, and functionality — including the Orby mascot, exercise designs, and visuals — are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

User Content:
You retain ownership of your progress data, test results, and preferences created within the app. This content is stored locally on your device and remains under your control.

6. Subscriptions and Payments

Orby Plus:
Orby offers an optional premium subscription, Orby Plus, that unlocks the full exercise library and premium features. Subscription details:

• Available plans: Monthly, Yearly, and a one-time Lifetime purchase
• Subscriptions are billed through the Apple App Store or Google Play Store
• Payment is charged to your app store account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your app store account settings
• Prices are displayed in the app and may vary by region

Refunds:
Refund requests should be directed to Apple or Google, depending on where you made your purchase. We do not directly process refunds.

Lifetime Purchase:
The Lifetime option grants permanent access to premium features for the lifetime of the app. This is a one-time purchase and does not auto-renew.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Orby, you agree to the terms of our Privacy Policy.

Key points:

• Your progress and test data is stored locally on your device
• We do not use analytics or tracking, and we do not sell your personal information
• You can delete your data at any time
• Notifications are optional and can be disabled

8. Disclaimers and Limitations of Liability

Service Availability:
While we strive to provide continuous service, we do not guarantee that the app will be error-free or uninterrupted. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

No Guarantee of Results:
Individual results from eye exercises vary. We make no guarantees regarding improvements to your vision, eye comfort, or any specific outcome from using the app.

Limitation of Liability:
To the fullest extent permitted by law, Orby shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including any decisions made based on exercise results or vision test outcomes.

9. Third-Party Services and Links

Orby may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

Third-party services we use include:

• Apple App Store / Google Play Store
• RevenueCat (subscription management)

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

10. Termination

We reserve the right to terminate or suspend your access to Orby immediately, without prior notice, for any reason, including but not limited to breach of these Terms.

Upon termination:

• Your right to use the app will cease immediately
• Locally stored data will remain on your device unless you uninstall the app
• Active subscriptions will be handled according to app store policies

11. Geographic Restrictions

Orby is available worldwide, but some features may not be available in all regions due to technical or legal restrictions. We reserve the right to limit the availability of the app in any geographic area at our sole discretion.

12. Changes to Terms of Service

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the app or on this page.

Your continued use of Orby after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the app.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the app shall be resolved through:

1. Good faith negotiations
2. Mediation (if negotiations fail)
3. Binding arbitration or courts of competent jurisdiction in France (as a last resort)

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Orby regarding the use of our app, superseding any prior agreements.
